MPCB consent

MPCB Consent Explained: CTE, CTO and Renewals

Discover the difference between Consent to Establish and Consent to Operate, and understand when businesses may need to apply or renew their consent.

Key points

  • Consent to Establish (CTE) generally comes before setting up or expanding a covered activity.
  • Consent to Operate (CTO) generally comes before operations start, and must be renewed.
  • Whether consent applies depends on your activity, its environmental category, and scale.

Many manufacturing and industrial activities in Maharashtra are subject to environmental requirements administered by the Maharashtra Pollution Control Board (MPCB). Two terms come up most often: Consent to Establish (CTE) and Consent to Operate (CTO). Here is what they generally mean.

Consent to Establish (CTE)

CTE generally relates to the establishment stage: setting up, expanding, or modifying a covered activity. Where it applies, it is typically considered before construction or establishment of the regulated operations begins.

Consent to Operate (CTO)

CTO generally relates to operating the covered activity. Where it applies, it is typically required before operations commence, and it is subject to validity periods and renewal.

Does your business need consent?

Applicability depends on your activity type, environmental classification, scale of operations, and the rules in force. An assessment of your processes and premises is the best way to identify which consents, authorizations, or renewals may apply.

Information typically involved

  • Establishment and ownership details
  • Description of manufacturing or industrial processes
  • Premises and site information
  • Details relevant to emissions, effluents, or waste, where applicable
  • Other prescribed documents and supporting records

Planning for renewals

Consents are not open-ended. Track validity dates, start renewal preparation well in advance, and review whether any changes to processes, production, or premises affect your consent before you renew.
